Welcome to CollegeSeats. These Terms of Service ("Terms") govern your use of the CollegeSeats website, mobile application, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
By creating an account, making a purchase, or otherwise using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. This includes accounts created when you sign up during checkout. Our Privacy Policy and SMS Policy are incorporated into these Terms by reference. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
You must be at least 18 years old to use our Service. By using CollegeSeats, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.
You need a CollegeSeats account to buy or sell. You can create one ahead of time or during checkout; the same rules apply either way. When you create an account, you agree to:
We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, outdated, or incomplete. Orders placed with false or borrowed information may be cancelled without refund of fees, and we may report the attempt to the card issuer.
CollegeSeats is an independent resale marketplace that connects ticket buyers and sellers. We are not the venue, the school, the box office, or the original seller of any ticket, and we are not affiliated with, sponsored by, or endorsed by any college, university, athletic conference, or ticketing provider. Prices are set by sellers and may be above or below face value. Sellers are responsible for complying with the ticket resale laws applicable in their jurisdiction.
Your card is charged at checkout. CollegeSeats, through its payment processor, Stripe, accepts your payment as the seller’s limited payments agent. Your payment to CollegeSeats discharges your payment obligation to the seller for that order, as if you had paid the seller directly. CollegeSeats is not a bank, money transmitter, or escrow service.
The total shown before you pay includes the ticket price and one fee that covers our service and payment processing. Sales tax is added at checkout where applicable. You are responsible for applicable sales taxes, which CollegeSeats may collect and remit to the relevant tax authorities.
Tickets transfer inside the ticketing provider where the seller’s ticket lives (for example Ticketmaster, SeatGeek, AXS, or a school’s own portal). The seller transfers your tickets to your designated delivery email. Your delivery email defaults to the email on your account; you may designate a different confirmed address at checkout. Delivery occurs when the transfer is available for you to claim.
You are responsible for claiming your tickets from the provider and for verifying event details (date, time, venue) before purchase.
All sales are final except as provided in this section.
Your payment is held by CollegeSeats rather than sent straight to the seller. The seller’s payment is released 48 hours after your tickets are marked sent. You have those same 48 hours to report a problem with your order: wrong seats, wrong game, or tickets that are invalid or never arrived. Reporting a problem pauses the release while we review it. Confirming delivery closes your report window; it never moves money on its own. If we confirm a problem you reported, you receive a full refund, including fees and taxes.
For any problem arising during the report window, you agree to use the report process described in this section before initiating a dispute with your payment-card issuer.
When you list tickets on CollegeSeats, you agree that:
Seller fees. Individual sellers pay 0% through January 31, 2027, and 5% after that. Brokers and high-volume sellers pay 5%. Whenever a percentage fee applies, the minimum fee is $2.50 per ticket. Your exact payout is shown before you publish a listing.
Payouts. Payouts are released through Stripe 48 hours after your tickets are marked sent. CollegeSeats may hold a payout while a buyer’s delivery report is reviewed, and may reverse or offset payouts for sales that are refunded under Section 7. To receive payouts, you must complete Stripe onboarding and accept the Stripe Connected Account Agreement. Where legal thresholds apply, your sales may be reported to tax authorities (for example, on Form 1099-K).
Parking passes are first-class listings on CollegeSeats. Everything in these Terms that applies to tickets applies equally to parking passes, including Buyer Protection and the report window (Section 7), buyer fees (Section 5), and seller fees and payouts (Section 8).
CollegeSeats may refuse, limit, suspend, or cancel transactions, listings, or accounts, including where we suspect fraud or abuse. We may also apply listing limits, price floors, claim windows, and verification requirements to listings, transactions, or accounts, including confirming a delivery email address or phone number before tickets are sent.
When using our Service, you agree not to:
The Service and its original content, features, and functionality are owned by CollegeSeats and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.
If you believe content on the Service infringes your copyright, send a notice to support@collegeseats.com that includes: (1) identification of the copyrighted work you claim is infringed; (2) identification of the material you claim is infringing and where it is located on the Service; (3) your name, address, telephone number, and email address; (4) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; (5) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf; and (6) your physical or electronic signature. We will remove or disable access to material identified in a valid notice and will terminate the accounts of repeat infringers.
Our Service may contain links to third-party websites or services that are not owned or controlled by CollegeSeats. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that CollegeSeats shall not be liable for any damage or loss caused by your use of any such websites or services.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, COLLEGESEATS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLLEGESEATS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to CollegeSeats in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless CollegeSeats and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of another.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our Service prior to the changes becoming effective. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
We may offer promotional or referral programs from time to time. Each program is governed by its own terms, which are incorporated into these Terms by reference and which we may change or end as those terms describe. By participating in a program, you accept its terms. The current Seller Referral Program Terms are at /terms/referrals.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
You and CollegeSeats agree to resolve any dispute, controversy, or claim arising out of or relating to these Terms or the Service through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that (a) either party may bring an individual claim in small claims court, and (b) either party may seek injunctive or other equitable relief in court to protect its intellectual property or to prevent unauthorized access to or use of the Service. You and CollegeSeats each waive the right to a trial by jury and the right to participate in a class action, class arbitration, or other representative proceeding.
You may opt out of this arbitration agreement by emailing support@collegeseats.com within 30 days of first accepting these Terms, stating your name, your account email, and your intent to opt out. Any dispute not subject to arbitration, and any action to confirm or enforce an arbitration award, shall be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
